By accessing or using Visuals ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all terms, you must immediately discontinue use of the Service.

2. Service Description & Disclaimer

IMPORTANT: Visuals is experimental, AI-powered software in active development. The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied.

• AI-generated outputs may be inaccurate, incomplete, or unsuitable for your specific needs
• Chart generation quality depends on data quality and format
• Features may change, break, or be removed without notice
• Service availability is not guaranteed
• Results are not guaranteed to meet your expectations or requirements

3. Payment Terms & No Refunds Policy

• Dissatisfaction with AI-generated results
• Service not meeting your expectations
• Technical issues or downtime
• Changes to features or functionality
• Inability to use the Service for any reason
• Account termination for Terms violations

By subscribing, you acknowledge that you are purchasing access to experimental software and accept all risks associated with its use. Subscription fees are non-refundable for any unused portion of the subscription period.

4. Chargeback Waiver

You expressly waive any right to dispute charges, initiate chargebacks, or claim unauthorized transactions for any reason. Any attempt to dispute legitimate charges will result in:

• Immediate account termination
• Permanent ban from the Service
• Collection proceedings for the full amount plus fees
• Legal action to recover costs and damages

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VISUALS AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability shall not exceed the amount you paid us in the past twelve (12) months.

6. User Responsibilities

You are solely responsible for:

• Evaluating whether the Service meets your needs
• The accuracy and legality of your data
• Verifying all AI-generated outputs before use
• Any decisions made based on Service outputs
• Maintaining the security of your account
• All activity under your account

7. Intellectual Property

All Service content, features, and functionality are owned by Visuals and protected by international copyright, trademark, and other intellectual property laws. You retain ownership of your uploaded data but grant us a license to process it for Service provision.

8. Account Termination

We reserve the right to terminate or suspend your account immediately, without prior notice or liability, for any reason, including breach of Terms. Upon termination, your right to use the Service will cease immediately. Termination does not entitle you to any refunds.

9. Indemnification

You agree to defend, indemnify, and hold harmless Visuals and its affiliates from any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Service or violation of these Terms.

10. Modifications

We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of modified Terms. We may also modify or discontinue the Service at any time without notice or liability.

11. Dispute Resolution

Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules. You waive any right to a jury trial or to participate in a class action.

12. Governing Law

These Terms shall be governed by the laws of Delaware, United States, without regard to conflict of law provisions.
